I asked an author of the Utah Digital Signature Act
last week whether encryption, of and by itself, would
constitute the legal force of signature. He said it
would.
Just a datum...
Hmmmm that seems a little silly to me since anyone can encrypt a message.
Encryption alone does not provide authentication.
Personally I don't like the way any of these Digital Signature laws have
been written. Too many issues involved that have been given little or no
consideration by people who do not have a good understanding of the
subject.
Anyone wishing in discusing this further please e-mail me off list.
