There is no final S/MIME v3 spec. Heck, there isn't even an *initial*
S/MIME v3 spec yet. That will appear on this mailing list within days.

The wording in the v2 spec is (hopefully) clear: to send something that is
signed and encrypted, you use nesting, not the SignedAndEnveloped data
type. Nesting is described in section 3.5 in the spec; SignedAndEnveloped
is not described anywhere in the spec other than in section 2.4 which
allows it but does not require receiving agents to even understand it.

The wording in the first draft of the v3 spec will be identical.

There is nothing prohibiting you from using SignedAndEnveloped (although
there are known security problems with it), but it is not part of S/MIME.
