I forgot to mention - since he's using the document function to access this
thing, it should still fail, because the document function is required to
parse an XML document (i.e., well-formed, with a single document element) not
a general entity (having some text and possibly multiple elements at the top
level).

So he will have to follow your advice but create a separate wrapper, like:

<?xml version="1.0" encoding="utf-8" standalone="no"?>
<!DOCTYPE doc [ <!ENTITY jsptext SYSTEM "text.jsp"> ]>
<doc>&jsptext;</doc>

and then access it via document('wrapper.xml')/doc
