This is a known erratum. See

it says for p. 167:

The second line in the first block of example code on
this page is incorrect.
  It should read:
     <xsl:attribute name="border">2</xsl:attribute>

Note this is only for the 2nd edition. The first is fine.

The same error exists in the first edition (p. 156); according to the
copyright page the latest reprint was July 2000, and I bought mine in
February 2001 (mere weeks before the 2nd Edition was published), so
apparently it wasn't caught until after 2nd Edition came out. (You're
correct, however, that it isn't listed as an erratum for the first
edition--should it be reported for completeness' sake?) But it's also a
very trivial example, which I think is Michael's point.

Ironically, I've come across code at work that does just this; apparently
the programmer assumed that in order to use conditional attributes, the
entire element must be constructed using xsl:element/xsl:attribute. I'm
also experiencing selective amnesia in recalling who that programmer was.
