that effectively means you are transfroming using HTML method. See
http://www.w3.org/TR/xslt.html#output about determining default output method.
If you need XML you should specify it explicitly in this case:

The problem is that this tag is not closed!
It *must* not be closed in HTML, see
http://www.w3.org/TR/html401/struct/global.html#edef-META:
"Start tag: required, End tag: forbidden"
