I'm guessing (I've asked), that Brian is right with the version
issue, but silent recovery is nasty in cirumstances like this IMHO.

The spec says that it's a recoverable error to supply an invalid name
here; the processor is allowed either to signal the error or
to recover
by not outputting the element node.

The author told me that xalan hadn't reported this as an error.
