That is OK but you would have to always pass the parameter, if you
called it without then the default value of an empty string would be
used and at that point $element[(_at_)name] is an error.
make the default a node set eg
<xsl:param name="element" select="."/>
then you can safely omit the with-param and use this default if suitable
