Well, of course you're using Xalan. (Duh.)

You might try using the EXSLT version of node-set() (see http://www.exslt.org), assuming your version of Xalan supports it. It shouldn't work differently, but it would at least allow you to test the stylesheet in another processor to help isolate the problem.
