That is an error 
It's a user error but not an xpath error, translate() is defined to
ignore later occurrences

http://www.w3.org/TR/xpath
   "If a character occurs more than once in the second argument string,
   then the first occurrence determines the replacement character. I"

so
 translate(assessmentType,'NotSet','Exam') -> Is what needed
is the same as
 translate(assessmentType,'NotSe','Exam') -> Is what needed

and translates NotSet to Exama
