group looks as follows:

if current-group() returns a sequence of zs_absatz which is what you
appear to mean (rather than a single item with a load of child
zs_absatz elements)

then 

current-group()/zs_absatz

will be empty as it is looking for zs_absatz of the items returned by
current-group().

so 

        <xsl:when test="every $x in
        current-group()/zs_absatz/listenpunkt/@ilfo satisfies $x eq
        current-group()[1]/zs_absatz[1]/listenpunkt/@ilfo">

probably wants to be

        <xsl:when test="every $x in current-group()/listenpunkt/@ilfo
        satisfies $x eq listenpunkt/@ilfo">

Note you used the correct path (without the zs_absatz step) on the next line,

                <zs_liste ilfo="{current-group()[1]/listenpunkt[1]/@ilfo}">


except it can equivalently be written as

                <zs_liste ilfo="{listenpunkt[1]/@ilfo}">
