It was hiding on page 390 of XSLT 2.0 and XPath 2.0 4th Edition, but
somehow I could not find it ;-)

With XSLT 2.0 there is
xsl:namespace
http://www.w3.org/TR/xslt20/#creating-namespace-nodes to create namespace
nodes so perhaps you don't need that code you have.
