Given that:

will cause an exception if /nothing returns (), what is best / most
efficient way to construct this variable?

<xsl:variable name="v1" select="/nothing = 'a' " as="xs:boolean"/>

That would work, of course (for well-formed XML).

If you want to be obvious about it:

<xsl:variable name="v1" select="exists(/nothing) and /nothing eq 'a'"
as="xs:boolean" />
