Yes, I agree. We should clearly specify what if any is the legal consequences of the interactions. But that is true with digital signatures too. (e.g If my private key is compromised and the CA took two hours to regenerate a CRL, and the merchant did not time stamp the CRL or used one on cache, then what will the outcome be in court? :-) Lawyers will have to be involved.
