Actually it is quite easy to specify RF terms that comply with the
definition that are utterly unacceptable commercially.

The problem is that other terms than a royalty requirement can be added.

RANDZ is RAND plus a zero royalty it actually comes down to being stricter
than rf under strict rf you can't require reciprocal rights which is
effectively the gnu approach

As for no patent, if the uspto researched prior art this would be viable,
but they don't. It is a complete scam. We just spent several million
defending a patent claimnf ssl. Even though we won in court the patent
holder extorted license fees from several parties.

The only way to avoid a patent issue is to know what has been filed only way
to do that is file.

It's either RAND ("reasonable and non-discriminatory") *or* RF ("royalty
free").  RF is *massively* preferred, as RAND cannot be used by
free/open-source software, since it requires the payment of "reasonable
and non-discriminatory" royalty fees.

No patent at all is much, much, more preferred of course; I'm very sorry
to hear you've taken this route. :(
