Until there is firm opinion from a competent patent attorney that SPF is
not covered I am assuming that it is. There are reasons for that beyond
M$'s basic behavior... someone besides Harry from M$ made a comment
basically saying that since SPF had not officially been on the table
they had not been required to make any IPR disclosures with respect to SPF.

Until there is a ruling from the court with all appeals exhausted, no
one will know for sure.

As far as that MS spokesperson, they are probably not aware that the
IETF Note Well IPR disclosure policy required Harry Katz and Jim Lyon
to disclose any claims against the MARID input documents when they
first started posting to the list. Once the mailfrom scope was
advanced by the co-chairs, they would have needed to make the
disclosure then too.

Sadly, from what I can tell, failure to follow the IETF IPR disclosure
requirements just means that it is a "violation of IETF process". Can
you say "paper tiger"?
