No, you can only copy nodes from an input tree,.
that input tree can be the source document though so without using an
extension element another way to get a node set based on your original
markup woiuld be
<xsl:variable name="test2"
select="document('')/xsl:stylesheet/xsl:variable[(_at_)name='Test']"/>
Note this is using xsl:variable with select= rather than having non
empty content, this will return a node set.
