Saxon is right, node() matches PI and XML comments.
I'd check with the xsltproc people whether their parser
by default delivers PIs and comments to the application
before filing a bug though.
Please fill a bug in bugzilla.gnome.org as pointed in
http://xmldoft.org/XSLT/bugs.html
I will try to fix this before the next release.
