No.

<div/> is valid acording to the XHTML DTD, a validating XML parser
which is what would be used in that case, can not detect the difference.

its just when people see well-formed html they think its xhtml,
which it isnt.
That's true of course.
<HTML>
</HTML>
for example has the wrong case and wrong namespace.
