No, I'm loading the XML from a COM object that I use in my ASP code, server
side.

So how come the processor still ignores the encoding specified in the
XML?
If yopu are loading the file from HTTP server, the encoding specified by
the server in the http heading has priority over <?xml dencoding
declaration. So check what encoding your server is specifying.
