Your description wasn't so clear but perhaps

<xsl:apply-template select="data[.='Functional Requirements']"/>
<xsl:apply-template select="data[.='Functional 
Requirements']/following-sibling::data[following-sibling::data[.='Design 
Derived Requirements']]"/>
</sec>
<sec>
<xsl:apply-template select="data[.='Design Derived Requirements']"/>
<xsl:apply-template select="data[.='Design Derived 
Requirements']/following-sibling::data"/>
</sec>

as always this could be made more efficient using keys (or xslt 2
draft's xsl:for-each-group, which makes this kind of thing much easier)
