I can only use EXSLT in my appliance
I don't think exslt has a parse function, but anyway just not putting
<?xml into the input would be a much better solution.
Having <?xml mid file even if CDATA quoted can serve no possible purpose as 
the only reason it is ever needed is to specify the file encoding as the
file is parsed from a stream of bytes into a stream of uniocde
characters before being parsed as XML. But if you are taking the string
from an XML document then you already have a stream of unicode
characters that has been decoded using the encoding of the outer
document so If you specify a different encoding here it can have no
effect, other than to cause a parser to mis-read the data.
