If \ is escaped with \\ then "\\," should be "\\\," so you might need
to remove all \\ occurrences first i think (although this wasn't

Yes, and it would become:
not(contains(replace(replace(., '\\\\', ''), '\\,', ''), ','))
but after Michael Kay's solution on xml-dev yesterday, this is old news.
