Actually, those words are included in a legend that will be
applied by document authors. Thus, the "speaker" is the
author, not the Trust. The author is telling the Trust (and
everyone else) that derivatives cannot be made to the pre-5378
material. Does that help with your discomfort?
It shifts it a bit, from having the Trust making an assertion it
may not really know enough about to having the (posting) author
make assertions about rights she doesn't know about rather than
just saying "contains old material and I don't know". Again, I
do not think it is a big deal.
