thats not it,
I just tried chmod u-x /var/spool/mail/*
and it appears to still be doing it, any other logs, configuration files
or permissions you want to know, just ask, because I just can't figure
this one out ...?

They are mbox files, they are not directories
Procmail may think they are bogus because they have the executable bit
set.
That's all I can think of that is different. Pick one that is giving you
the BOGUS warnings and turn off the 'x'. See if that helps it.
