Solution, rather messy.

</ul>
then manually insert an id value into each title.
<h3 id='buri'> .....
I had a key based solution but it was too flaky:-)

Fairly ordinary stylesheet,
Only one template match on /
rest is simple generated content, occasionally using
document() to get a few nodes.
generate-id() generates an id based on the current node in
the source
(which happens to be the stylesheet in your case, but that's not
relevant)
I guess its what's making my head hurt.
So the question is, what is the current node when
<ul>
<xsl:for-each select="//h3">
<li><a href="#{generate-id()}">
is executed and what is the current node when
<h3 id="{generate-id()}">
is executed?
Duh? I think is appropriate(again ).
The latter uses source document current node which is the root of
the stylesheet.
OK. Back to the drawing board.
Even Jeni's position() based id's won't work.
Heck I don't want to hand write a toc David :-)

and yes, it is saxon 7.4 btw, not 652 as I said.
