  Probably, something like following will work -

<xsl:output method="xml" indent="yes" />
  
<xsl:template match="step[child::step]">
  <ol>
   <!-- other processing -->
  </ol>
</xsl:template>
  
</xsl:stylesheet>

Solaris and Perl + 
Sablotron as a production system.

Someone must have had and solved this same
problem... Apparently I 
googled for the wrong search terms.
