Strange. Xalan 2.7.0:
~/drafts/xslt $ cat empty.xsl
<xsl:transform xmlns:xsl="http://www.w3.org/1999/XSL/Transform"
version="1.0">
<xsl:output method="html"/>
<xsl:template match="/"><html><br/></html></xsl:template>
</xsl:transform>
~/drafts/xslt $ xalan -XSL empty.xsl -IN empty.xsl
<html>
<br>
</html>
~/drafts/xslt $

used? So you could use a correct implementation.
