Actually, this second part is a concern of _any_ use of of encryption,
including duly licensed copies.  And, as "export" has a vague and
all-encompassing definition, it -- and not any patent issues -- has
prevented me from recommending _any_ form of encryption, INCLUDING THE
VERSION OFFERED BY RSA.

And this is exactly the effect this law is supposed to have.  In case
you havn't seen it, there was an excelent series of articles in
"Communications of the ACM" a few months back which had alot of harsh
words to sling at the NSA for blocking the use of encryption both in
the US and abroad.
