I understand this differently, and if it is open to inpertretation then it
will be interpreted to MS's advantage by their lawyers - that's what they
are paid for :-)
Please re-read the disclosure :-
<quote>
Both Sender ID: Authenticating E-mail <draft-ietf-marid-core-03.txt>
and Purported Responsible Address in E-mail Messages
<draft-ietf-marid-pra-00.txt> in combination.
</quote>
Note "in combination" .. This does *not* state what these documents are in
combination with. If it was meant to clearly state that these documents
were the only ones involved, the wording would be :-
"Both Sender ID: Authenticating E-mail <draft-ietf-marid-core-03.txt>
and Purported Responsible Address in E-mail Messages
<draft-ietf-marid-pra-00.txt> either separately or combined together."
I have no doubt that this was submitted by MS's legal team, and they will
definitely not miss a nuance like this in the small print. I would be
interested to hear a professional legal opinion on this point to refute Anne
Mitchell's observations, but I have seen none yet on either of the mailing
lists and I can't afford the fees myself.
For clarification - I have about 35 years business experience, with large,
multinational companies as well as small "one-man-band" ones. I have
written and implemented international contracts. I have been to court in UK
and other countries over patents, permits. licences, contracts, insurances,
etc., both in defense and prosecution. I know how it goes in court, and I
also understand lawyers quite well as a result.
Slainte,
JohnP.
