From what I know of software patents, which is very little,
it seems to me that Microsoft got burned by EOLAS, and so it
decided it didn't want to get burned again; unfortunately,
there is a very fine line between a defensive and an
aggressive stance.
The fundamental problem is the patent system. Yes, it's
unfortunate that Microsoft is involved, but if any other
company were holding the cards, who's to say that wouldn't
be just as bad? Unless that company were, say the Internet
Society or the EFF or something. The real problem is that
the cards are being dealt at all.
