I suggest that we proceed under the working assumption that
the patent apps do not in fact cover SPF Classic.

Wrong question. It does not matter. Regardless the patent apps cover or
do not cover SPF Classic, it is a matter of interpretation (what do I
know anyway, IANAL) that can be challenged in court and here's the real
question: who can survive a billion dollar lawsuit (that spreads over
10+ years with appeals) over them from an organization that can spend 2
billion dollars in legal fees if need be?
