There's a "SHOULD check at the border", and receivers deciding to accept
known FAIL results at their border without compelling reasons would be
mad.  For starters they'd have to guarantee that it's not bounced later,
the RFC 2821-clause "to the originator as indicated by the reverse path"
doesn't justify "even if their sender policy states that this is a lie".

I had to accept FAIL email from blockbuster because their SPF policy 
didn't list the company they were sending mail through.  However,
I soon realized that this was essentially like alias forwarding, and
allowed custhelp.com to forward blockbuster.com email rather than
allow general SPF FAIL for blockbuster.com.  

Eventually, they fixed the mail from to say custhelp.com instead of
blockbuster.com, but then they removed their SPF record also :-(
