The rules for conflict resolution are pretty simple
http://www.w3.org/TR/xslt#conflict
match="section" has priority 0 (because of the second rule)
match="*[(_at_)tocOut]" doesn't match any special case so has a priority of
0.5 (because of the last rule)
So *[(_at_)tocOut] has higher priority.
If xalan isn't doing that you should report a bug.
