Yes. These are the categories CAN-SPAM describes as "transactional and
relationship" mail. They are explicitly exempted from the labelling
requirement.
That's a relief, so if someone is designated as "opt-in" does not need a
label on mail sent to them

And when reading the fine print for most opt-ins it usually says something
