My understanding is, as long as you are peaceful and don't sue anyone
else, you're all set. You don't need to know that Linux exists,
even.
That's not the impression the OIN webpages gave me. Their FAQ, for
example, says
We are making the patents available royalty-free, and all we ask in
return is that the licensee agrees not to assert its patents against
Linux.
The license agreement at
http://www.openinventionnetwork.com/pat_license_agreement.php has
Linux-specific language and as far as I can see does not give any
protection to those not using, working with, or at least somehow
involved in Linux.
Perhaps I just missed something.
Not that I think it really matters as far as spamsalt is concerned;
having to do _anything_ in order to legally use the technique is, I
expect, going to be a substantial barrier to adoption.
If I cared about USA patents, it would certainly kill it for me.
