While that is absolutely necessary, it's possible it's not

spammers or jurisdictional issues on the enforcement side.
Indeed. I was addressing the necessary condition only. I would
have included the jurisdictional issues as part of "enforceable
and enforced", but that doesn't change either of our essential
points.
