Why not?

Unless a domain is unused for a year it seems reasonable to
assume it is still owned by a known spammer.  So why expire
it?

Because otherwise the BL would actually have to check the domain 
on each query about it to make sure it hadn't changed owners since 
the last query -- or else risk screwing a perfectly innocent party
who just bought the domain not knowing of its history.
