That could only happen with a dedicated mail-out for
non-empty Return-Paths using an SPF FAIL HELO. Maybe
not impossible, OTOH a clear error.
My concern is that I don't want to violate sender policy by
"re-interpreting" an SPF record in a way that might not be
intended by the sender.
No chance, it was always MAY (now SHOULD) test HELO, and
you'd always interpret it this way for empty Return-Paths.
