Domains don't subscribe to mailing lists, individual recipients do.
The
recipients in a domain may oppose the domain[-administrator]'s
decision,
but often lack the power to have it changed. "Failure to quit your

cannot reasonably be construed as consent/support in this context.

This just brings us back to the "Do domain owners have a right to
control
how their domains get used in email" question.

If they do, the point is irrelevant.

If they don't,  email authentication policy is wrong and we should
just
stop.
