What distinguishes between a large and small list and how can you tell?

ISPs and others start refusing to deliver their traffic.

How do you detect when a list grows or shrinks across that threshold?

The traffic stops being delivered.

What incentive is there for the operator of a list to be transparent
about the fact that his lis has cross the threshold in either direction?

His traffic is being thrown on the floor.

I've in the past blocked fluff mailing lists from Fortune 100 type
companies because they just gummed up the works with zillions of user
unknowns etc.

I'm sure they'd've argued that what they'd done should be acceptable
if I'd ever had the slightest inclination to ask.

Anyhow, you seem to believe you're talking to the Wage and Price
Control Board, to use a venerable early 1970's analogy.
