I believe you, but what kind of AV is going to decide it's a virus for
one recipient but not for the other?

Right. I think this is different - virus vs decisions about subjective spam or attachment holds, etc. An AVS detected virus, which implies the virus "DNA" was recorded in some AVS database, should make this a 'system-wide' rejection policy.
