I agree with you entirely here, and so should everyone else on this list since
this list itself is a perfectly good example of solicited bulk email. If mail
is solicited then it is not spam, full stop. It doesn't matter if the content
of the email is technical or marketing-related. Spam is about conSent, not
conTent.
Unfortunately many commercial bulk mailers do not exercise proper due
diligence about whether or not the mail *is* actually solicited (e.g. by
confirming with the address owner that it really was them that typed the
address into a "sign up" web form). That, I think, is where many bulk mailers
run into trouble.
