Technically, according to RFC4408, you can only do that if you get the
a valid type99 SPF record first since you are supposed to ignore any
TXT records in that case.

This is similar to the fudging of the standard in the case of "timing
out on the TXT record and no type99 records found" being considered a
TempError.  You can argue that you are simply doing pre-processing
before you are really doing any SPF checking, but you should probably
practice saying that with a straight face a few times before you say
it in public.
