I share your concerns.  It is better to avoid mixing such policies with the 
charter.   We should not be reading in between the lines. :)

I suggest that all contributors read RFC 3668.  I understand that the group 
"have the discretion to adopt technology with a commitment of fair and 
non-discriminatory terms".
