I would also like to note that Domainkeys is claimed to be a trademarked
term (and not by yahoo). Something for IETF to investigate as well so you
don't get surprises after last call :)
A five-second search on uspto.gov shows that DomainKeys was registered by Yahoo
over a year ago.
http://tess2.uspto.gov/bin/showfield?f=doc&state=d63mtq.2.1
Its *filed*, not registered. I warned you in private that its not that
easy if somebody else has used the term for at least 3 years and claimed
common trademark on it.
But since you insisted here is what you got for your efforts:
(words only): DOMAINKEYS
Standard Character claim: Yes
Current Status: An office action making FINAL a refusal to register the
mark has been mailed.
Date of Status: 2005-03-23
Filing Date: 2004-01-28
...
PROSECUTION HISTORY
---------------------------------------------------------------------------
2005-03-23 - Final refusal e-mailed
2005-03-23 - Final Refusal Written
2005-03-21 - Amendment From Applicant Entered
2005-02-23 - Communication received from applicant
2005-02-23 - PAPER RECEIVED
2004-08-24 - Non-final action e-mailed
2004-08-20 - Case file assigned to examining attorney
2004-02-05 - New Application Entered In Tram"
Now that they refused to register your trademark filing, the original user
may try to go at it and may well succeed.
