If i understand correctly, it *is* illegal, except if the ISP / mail service
customer allows it (i.e. by contract). Where spam fighting is getting
"intrusive" be the meaning of that law (i.e. using Headers, subject, body
etc.), is a bit unclear afaik.
So the most Herman ISPs (should) have a corresponding part in their
contracts...
On the average over the years, substantive discussion of legal details,
relative to work in the IETF, has proved unhelpful to that work.
Sometimes the entertainment value has been significant, however, but not
any intended engineering guidance.
