has more investigative powers, would have to fight spam.

If you want to fight spam privately, you often have no means to find out
whom the spam is from, you can only deal with the single message the
spammer sent to you (unless you do a class action, which is not
available in every legislation), and you have the risk that your legal
expenses are not covered (even in legislations where procedural law does  
regulate that the party who lost the suit has to pay the legal expenses  
of the other party).
