The definition of "damage" is a philosophical question.

If I take an action, and as a result you're worse off than you'd be if
I hadn't taken it, have I damaged you?

I think that's the wrong question.

If I take an action, and as a result you're worse off than you were
before I took it, have I damaged you?

Today, you have no idea whether you can reach someone by email next
week. Tomorrow, your IP is added to a list. You still have no idea
whether you can reach him next week. Next week, you attempt to email
him, and fail. Did adding your IP to the list make you worse off?

A website is having a "pick the funniest joke" contest. I vote for a
joke that isn't yours. Have I damaged you? You're worse off, being
less likely to win, as a result of my action.

A friend was planning to buy food from your grocery store to cook for
dinner. I invite her to a restaurant. Have I damaged you?
