Yes there is.

You can fine them or lock them up for breaking the law. That will prevent
them from dialing random numbers, or sending out spam.

Yes, in most cases involving actual criminal punishment, there usually there is a tangible loss directly attributed to an entity, that would have been impractical to avoid.

There is no prosecutable entity "Spammer" much like there is no prosecutable entity "Mafia". It's obvious that there exists "Mafia", and that this "Mafia" does not hold legal constructs as a significant deterrent to its operation. Despite laws, "Mafia" continues to do what it does, whatever that is. Now, should "Mafia" decide that someone specific ought to be whacked, "Mafia" will find a way. You might not be safe from an entity like "Mafia". Then again, your security with respect to "Mafia" is not from law but from the fact that you are personally uninteresting and obscure enough to never have to worry about them putting forth the effort.

Yes, being boring and difficult are assets when it comes to "Mafia". Ego 0, common sense 1.

You might be responsible to yourself to not become a target of "Mafia" by being interesting, obvious, and easily accessible to them. So to, you might be responsible to yourself to not become a target for "Spammer" in similar ways, for I don't think "Spammer" follows the same laws other people do, either.

As a Systems Developer, you might personally accomplish more to give your end-users reasonable methods of self-defense and barricades than wait for laws to handle their problems.
