Yes.  It needs to be in MAIL FROM so that rejections can take place
before receiving the entire message.   The Received mail header fields
are nice, but you can't get to them without going to DATA.

An enhancement to SMTP protocol to allow rejection after the mail header
might be in order.  But, of course, spammers would always pretend to 
only understand the old way.
